About Us

Eleven 8ths Bakery LLC is a husband-and-wife home bakery based in Buffalo, New York, operating as a registered New York State Home Processor. You can reach us anytime at info@eleven8thsbakery.com.

Orders

All orders placed through the Site are offers to purchase and are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud. If we cancel an order after payment, we will refund you in full.

Product photos are representative. Because every item is made by hand, the exact look, weight, and decoration of your order may vary slightly from what is shown.

Pricing and Payment

Prices are listed in U.S. dollars and may change at any time without notice. Applicable sales tax will be added at checkout where required.

Payments are processed securely through Stripe. We do not store your full payment card details. By placing an order, you confirm that the payment method you use is yours and that you authorize the charge.

Pickup and Delivery

We offer local pickup and local delivery within the Buffalo and Western New York area. Pickup and delivery times will be confirmed by email after your order is placed.

It is your responsibility to pick up your order at the scheduled time or to be available to receive a delivery. Orders that are not picked up or that cannot be delivered due to an incorrect address or no one being available may not be eligible for a refund, as our products are perishable. Risk of loss passes to you upon pickup or upon completion of delivery to the address you provide.

Cancellations, Refunds, and Issues

Because our items are made fresh to order, we generally cannot accept cancellations once baking has begun. If you need to change or cancel an order, please contact us as soon as possible and we will do our best to accommodate you.

We take pride in every order we send out. If something is not right with your order, please reach out within 24 hours of pickup or delivery and we will make it right, whether that means a replacement, store credit, or a refund at our discretion.

Allergens and Food Safety

Our kitchen handles wheat, dairy, eggs, tree nuts, peanuts, and soy. Even products that do not list these ingredients may come into contact with them. We cannot guarantee that any item is free from allergens. If you or anyone who will eat the product has a severe food allergy, please do not order from us — we cannot eliminate the risk of cross-contact in our shared kitchen.

Every product is labeled with a full ingredient list and net weight. If you have specific concerns, please contact us before ordering. You are responsible for reading labels and for any dietary or allergen decisions you make.

Most of our baked goods are best enjoyed within a few days. Store them in an airtight container at room temperature unless otherwise noted. Cookie Jars should be refrigerated after opening.

Accounts

You can check out as a guest or create an account. If you create an account, you are responsible for keeping your password secure and for all activity on your account. Notify us right away if you believe your account has been used without your permission.

Intellectual Property

All content on the Site — including our name, logo, recipes, product descriptions, and photography — belongs to Eleven 8ths Bakery LLC or our licensors and is protected by U.S. copyright and trademark law. You may not copy, reproduce, or use our content for commercial purposes without our written permission.

Site Disclaimer

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful code, and we make no warranties about the accuracy, completeness, or timeliness of any information on the Site. To the fullest extent permitted by law, we disclaim all implied warranties relating to the Site, including merchantability, fitness for a particular purpose, and non-infringement.

This disclaimer applies to the Site itself. It does not limit any warranty, right, or remedy you may have with respect to the food products you purchase from us.

Limitation of Liability

To the fullest extent permitted by law, Eleven 8ths Bakery LLC will not be liable for any indirect, incidental, special, or consequential damages arising out of your access to or use of the Site, including any errors, downtime, inaccuracies, lost data, or unauthorized access to your account.

This section is about your use of the Site only. It does not apply to claims relating to the food products you purchase from us, which are governed by applicable law and the other sections of these Terms.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury, gross negligence, willful misconduct, fraud, or any non-disclaimable warranty applicable to food products.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Erie County, New York.

Force Majeure

We are not responsible for delays or failures to perform caused by events outside our reasonable control, including illness, equipment failure, power or internet outages, ingredient shortages, severe weather, or government action. If we cannot fulfill an order due to one of these events, we will contact you to reschedule or refund your order.

Electronic Communications

When you place an order or create an account, you consent to receive communications from us electronically, including by email. You agree that any notices, agreements, disclosures, or other communications we send to you electronically satisfy any legal requirement that such communications be in writing.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will take reasonable steps to notify account holders, such as by email or a notice on the Site. Continued use of the Site after the updated Terms take effect means you accept them.

General

These Terms, together with any order you place and our Privacy Policy, are the entire agreement between you and Eleven 8ths Bakery LLC regarding your use of the Site and your orders, and they replace any prior understandings on those subjects. If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign or transfer your rights under these Terms without our written consent; we may assign these Terms to a successor in connection with a merger, acquisition, or sale of our business.
